Gospel Legend Percy Bady Wins Song Copyright Battle!

 

Federal Judge Says Copyright Case Against Norm Gyamfi’s Tribl Records, LLC.. Will Proceed to Discovery!
ATLANTA, GA: June 1, 2026!
Acclaimed gospel songwriter, producer, and performing artist Mr. Percy Bady secured a key ruling in the United States District Court for the Northern District of Georgia, where the Court denied the central thrust of Defendant Tribl Records, LLC’s motion to strike, preserving Mr. Bady’s claims for statutory damages and attorneys’ fees as his copyright infringement case advances toward discovery.
Mr. Bady is the author of the 1987 gospel classic “I’m Free,” first recorded in November 1988, and has had dozens of hits for major artists.
Over the decades, the “I’m Free” song has become a staple of the gospel canon, covered and reinterpreted by artists across generations. Mr. Bady is the registered owner and author of the work with the United States Copyright Office (Copyright PA 2-519-436).
Mr. Bady’s original lawsuit sued Todd Galberth and Tribl Records, alleging that the recording “Fill the Room”, produced and performed for release by Tribl Records and distributed beginning in October 2022, incorporates verses and the chorus of “I’m Free” without authorization.
According to the complaint, Tribl released, distributed, and promoted the work, including an official music video posted to YouTube that has amassed more than 1.2 million views.
Mr. Bady’s amended complaint asserts claims for copyright infringement and vicarious copyright infringement under the Copyright Act.
In its ruling, the Court rejected Tribl’s effort to eliminate Bady’s request for statutory damages and attorneys’ fees, agreeing that questions surrounding the timing and manner of the alleged infringements, including the vicarious infringement claims, are fact-intensive issues properly developed through discovery rather than resolved at the pleading stage.
The Court emphasized that motions to strike are disfavored and that any doubt about whether a matter may bear on the litigation must be resolved in favor of the non-moving party.
“I am truly grateful to God for this favorable report and for His faithfulness every step of the way,” said Mr. Bady, who resolved the matter with former defendant Galberth earlier this year and maintained the case against Gyamfi’s company.
Mr. Bady also mentioned, “I want to give a special thank you to Attorney James L. Walker, Jr. and his legal team for standing firm, staying the course, and representing those who often don’t have the ability to fight these battles alone. Your commitment, diligence, and unwavering resolve are deeply appreciated.”
Although Mr. Bady will not seek punitive damages, the practical effect of the ruling is that Bady’s most significant remedies remain fully in play as the case proceeds, and the parties have been ordered to file a Joint Preliminary Report and Discovery Plan within two weeks.

With the Court’s ruling in hand, Mr. Bady’s legal team intends to move aggressively into discovery to develop the full record of the alleged infringement and to vindicate Bady’s rights as the author of “I’m Free.”
A man of limited words, Mr. Bady added in his official statement, “At the end of the day, it’s never simply about who is right—it’s about what is right.”​​​​​

Karen Clark-Sheard

Did you know that in 2001, Karen Clark-Sheard was faced with a life-threatening crisis when a blood vessel burst during a scheduled hernia surgery? Her doctors only gave her a 2% chance of survival due to her complications. After the blood clot was surgically removed, Karen fell into a coma. The coma lasted three and a half weeks, but Karen made a miraculous recovery and recorded her sophomore album, 2nd Chance (named so because of the second chance given to her by God) in 2002. Karen Clark-Sheard’s near-death experience is referenced in her daughter Kierra’s song You Don’t Know. Singers Mariah Carey, Faith Evans, and Beyoncé all count Karen Clark-Sheard as one of their greatest vocal influences.
